Non-Pecuniary Damages: A New Decalogue
by Anna Malomo In the perspective of a personalisation of personal damage and a downsizing of the rigidity of pre-established tabular criteria, we analyse what has been achieved by the Third Section of the Italian Court of Cassation (Corte di Cassazione), a little more than a five-year period after the Italian Court of Cassation-Joint Sections of November 2008, for which the protection of the human person and the integrity of the compensation of this value are central.
